The Client acknowledges that he has been informed and has accepted the fact that the offer to stay by the following Terms and Conditions of Sale.

1 - Acceptance of Special Terms and Conditions and Order
 
1.1. These Special Terms apply to any order of stay (« the Order ») carried out by an unregistered travel body (« the Client ») with the company La Nouvelle Société Avant-Scène.
The text may also be obtained by simple request addressed to the company’s headquarters.
By Order, we mean all booking requests emitted by the Client where the company La Nouvelle Société Avant-Scène has confirmed the availability.
1.2. The Client hereby acknowledges having the capacity to contract to the conditions described in the present Terms of Sales, i.e. has a legal majority and is neither under supervision authority or curatorship nor under any collective procedure.
1.3. The Client hereby acknowledges that he has read the present Terms and Conditions of Sale in its entirety, as well as all the terms of the proposal, before placing his Order. Therefore, the Order request leads to the Client’s total adhesion to the Terms and Conditions of Sale of the company La Nouvelle Société Avant-Scène.
1.4. A booking request will be processed by the company La Nouvelle Société Avant-Scène upon receipt of the online order, duly confirmed by the Client, and receipt of payment. Both of these conditions are cumulative.
 
2 - PRICE /PAYMENT
 
2.1 Price
2.1.1. All prices are presented in Moroccan Dirhams. The currency rates in Euros and US Dollar are also mentioned. These should be confirmed upon reservation.
The prices are inclusive of VAT upon order.
The invoice mentions the 4% of the total amount for banking charges.
2.1.2. Only those services explicitly mentioned in the description of the stay will be included in the price.
On principle, the following services are not included in the price:
1.Any service before landing on Moroccan soil or after takeoff from Moroccan territory.
2.Personal expenses (tips, telephone, various deposits, others…)
3.Vaccination and visa fees,
4.Insurances,
5.Optional tours not ordered online.
 
2.1.3. No objections regarding service prices will be taken into account once the Client has made his order request.
2.2. Reservation Fees
Every Order will be charged the equivalent of 4% management fees, amount in Moroccan Dirhams (Administration Fee).
2.3 Payment Methods
The Client can make his payment online:

2.4. The processing of the order will depend on the payment method to the company La Nouvelle Société Avant-Scène.
Charging by payment methods, it is understood that:
- All purchases by credit cards need valid banking details, with credit card and payment validation from the bank card center,?- for purchases via bank transfer, only the Client’s bank transfer confirmation is necessary,
2.5. Payment Conditions
The total invoice must be settled upon placing the Order.
 
3 – CLIENT CANCELLATION
 
3.2. Order Cancellation
An Order is effective once the company La Nouvelle Société Avant-Scène has confirmed the availability of the stay with the Client.
3.2.1. Any cancellation must be addressed by e-mail to the following address: info@symphos.com
The date of receipt of the e-mail will be held as the date of cancellation.
This will lead to a minimum charge of the following fees, in each case:
1.Administration Fees
2.Bank Charges
 
The Client can also claim, in the case of a cancellation before the:
1.Before the 01/02/2015: 100 % refund of the total invoice amount
2.Before the 22/02/2015: 50 % refund of the total invoice amount
3.After 15/03/2015: No refund
 
Should there be a refund, it shall be paid within 30 days of the cancellation date.
The company La Nouvelle Société Avant-Scène informs its Client that he has the option to be insured by the company of his choice, to cover the charges incurred by the cancellation.
3.3. Transfers
The Client may transfer his contract to a third party, if the person is part of the same company reserving, as long as the company La Nouvelle Société Avant-Scène has been informed via e-mail, at the latest 7 days prior to the stay, specifying the name(s) and address(s) of the transferee(s) and those participating to the trip, stipulating that they fulfill the same conditions to make the voyage.
 
4 – AGENCY CANCELLATION/MODIFICATION
 
4.1 Cancellation
4.1.1. Should the company La Nouvelle Société Avant-Scène be forced to cancel a trip, the Client will be informed. The Client will then be entirely reimbursed by the company La Nouvelle Société Avant-Scène of all sums paid.
4.1.2. Should the cancellation be imposed by circumstances of Force Majeure or relating to the security of the passengers, the Client will not be able to make a claim
4.2 Modification
The Client is informed that the description of the stay is generally the rule, though the Client may notice and be subjected to exceptions.
Specifically, the Client could be staying in different hotel accommodation than initially planned, but with the same standing.
Our local service providers could cancel certain activities presented in the description. Should this be the case, the company La Nouvelle Société Avant-Scène will refund all cancelled services.
The company La Nouvelle Société Avant-Scène cannot be held responsible for any activities cancelled by Force Majeure or due to the Client.
 
5 - MISCELLANEOUS
 
5.1. The company La Nouvelle Société Avant-Scène cannot be held responsible for any activities contracted outside the Order.
5.2. Photos and illustrations
The company La Nouvelle Société Avant-Scène strives to illustrate its travel deals with photos and illustrations that give a realistic idea of the services presented. However, the photos and illustrations in the travel descriptions are only to give an indication of the category or level of standing of the services it refers to.
5.3. Formalities
The Client must, depending on the country, be:
- In possession of the necessary travel documents for a stay on Moroccan soil. ?- up to date with all the required vaccinations.
The company La Nouvelle Société Avant- Scène cannot be held responsible for :
- Fines or sanctions, as a result of failure to comply with health, administrative and/or customs regulations in Morocco or any consequences that could result from the aforementioned incidents.?- the Client’s failure to embark due to the lack of valid identification and/or health documents necessary to complete the stay.
The company La Nouvelle Société Avant- Scène will make no refunds or compensations as such.
 
6 - FORCE MAJEURE
 
It is understood that Force Majeure is any exterior event that presents unforeseeable and overwhelming characteristics, that would stop either the company La Nouvelle Société Avant-Scène or the service providers involved in the organization of the stay from executing part or all of their contracted obligations?.?This encompasses situations such as:
- General strikes that may hit transportation, hotel, or airport personnel ?- uprisings and riots?- prohibitions dictated by the public authorities or the government?- climatic or geographic conditions, health conditions or policies that could endanger the life of the Client.
 
7 - CLAIMS
 
For your claims to be rapidly processed, they must be addressed to the company La Nouvelle Société Avant-Scène by registered mail within 30 days of the stay.
We encourage you to let us know of any difficulties linked to non or poor performance of the services as soon as possible, by letting the local managers know if any of the activities do not meet with your complete approval.
 
8 – CIVIL LIABILITY
 
The company la Nouvelle Société Avant-Scène is insured for Civil Professional Liability with the AXA ASSURANCE insurance company.
The notion of civil liability (accident, fire, theft, others) changes depending on the countries legislations, so it is advised to the Client to be protected by an individual complementary insurance policy. .
 
9 – INFORMATION TECHNOLOGY AND RIGHTS
 
The computer data used for the stay will be transferred to the l’Office Chérifien des Phosphates, and then destroyed by the company La Nouvelle Société Avant-Scène.
 
 
10 - APPLICABLE LAW
 
The present Terms and Conditions of Sale are subject to Moroccan Law. Any dispute concerning their interpretation and/or execution comes within the competences of the Moroccan Courts.
 
11- FINAL MEASURES
 
Should the company La Nouvelle Société Avant-Scène not prevail, at any time, over one of the dispositions stated in the present Terms of Sale, it is by no means relinquishing the conditions it has subsequently accepted.
Should one of the present dispositions of the Terms of Sale be declared null and void, it will be stricken, without it affecting the other terms, unless the term declared null and void is essential and decisive.
